What if ObamaCare is The Crisis, not The Prize?

We’ve assumed that ObamaCare is the prize, and that the financial crisis is The Crisis not to waste.

But what if ObamaCare is The Crisis, and the administration will gladly let it go by the wayside?  Their eager echo of Randy Barnett’s request for all due haste in taking it to the Supreme Court left us all scratching our heads.  There are some good theories out there, but none seem to fit well enough to get my spider-sense to stop tingling.  Now the administration dumps the CLASS act just because the implementation is prohibited by law (based on some requirements we stuck in at the last minute, whew!).  But breaking laws with impunity is a defining characteristic of this administration, so I don;t think they are tearing limbs off of ObamaCare just out of an abundance of propriety.

I smell a trap.

What if the administration is truly happy to lose ObamaCare this term, confident that if they lose they get to call Republicans even MORE dirty names for it in the future?  The real prize then would probably be something more mundane, more pernicious, probably buried deep within the regulatory state, as the bureaucratic process which has replaced our Republic evolves into a self-authorizing system of compulsory taxation regardless of representation.

Hillary did it with “HillaryCare”, when after going down in flames, she nonetheless press-ganged hordes of staffers and functionaries into a policy-manual rewriting team, so that regardless of laws, orders, or decisions (the three results from the three branches of government), the things she wanted done by the United States Civil Servants would be done.  What she could not do was compel funding, but she hardly let that stop her.

Obama’s DoJ is full of Marxist political hacks.  The Jackson EPA is a horror show of runaway regulatory authority, and the FCC like the INS simply writes rules for itself when it fails to get what it wants as laws.  What if all these myriad tiny stories are the real problem, and the big showy items like ObamaCare and #Occupy are diversions?
